Signed at the Buffalo Bills Training Camp, with attendance from NFL and Bills officials, and the family of Desha, the bill’s namesake, this law aims to enhance preparedness for sudden cardiac arrest incidents within school environments. This initiative builds on previous efforts to bolster youth heart health, significantly supported by Buffalo Bills Safety Damar Hamlin’s advocacy following his on-field cardiac arrest. The new mandate will ensure that schools are equipped with trained personnel and appropriate measures to respond effectively to life-threatening cardiac emergencies, safeguarding students and contributing to the state’s broader commitment to youth physical and mental well-being.

Governor’s Historic Investments Support Statewide Efforts Boosting Youth Physical and Mental Health
Governor Kathy Hochul today signed Desha’s Law (S.5539A/A.785A), a bill requiring every public school in NY to have a cardiac emergency response plan in place. The Governor was joined by the bill’s sponsor, Senator April Baskin, and is named after Senator Baskin’s late cousin, who tragically passed away at school. The bill signing took place at the Buffalo Bills Training Camp where the Governor was joined by Desha’s family, and leaders from the NFL and Buffalo Bills. Bills Safety Damar Hamlin, the Bills, and NFL have been powerful advocates for heart health and implementing critical training and resources in schools and youth sports following Damar Hamlin’s cardiac arrest in January 2023 in which he had to be resuscitated on the field during a game against the Cincinnati Bengals. Governor Hochul previously signed legislation requiring camps and youth sports programs to establish automated external defibrillator, or AED, implementation plans and to have at least one person trained to properly use the AED at camps, games and practice.
“Today is an important day in New York as we take a major step to protect our kids and school communities in the moments that matter most,” Governor Hochul said. “No family should have to experience the heartbreak of losing a child when a life could have been saved. Desha’s Law will ensure our schools are prepared to respond in an emergency, giving every student a better chance at a healthy, active life. It is also another testament to New York’s commitment to getting kids off their phones and outside to play sports, have fun with their friends and experience life to the fullest.”
Desha’s Law (S.5539A/A.785A) requires schools safety plans to include a cardiac emergency response plan that addresses the use of appropriate personnel and measures to respond to incidents involving any individual experiencing sudden cardiac arrest or similar life-threatening emergency on any school site owned or operated by a school or at a location of a school sponsored event.
State Senator April N.M. Supporting Youth Physical and Mental Health:
- As a part of the Governor’s “Unplug and Play” initiative, the FY26 budget included an additional $15 million to support Youth Sports and Youth Development Programs across the state, administered by the NYS Office for Children and Families. Unplug and Play also includes the partnership of OCFS and OMH to connect state-funded afterschool LEAPS program staff to vital mental health first aid training so they are able to best serve youth in their programs, meeting them where they are.
- Governor Hochul’s FY26 Enacted Budget further expanded the Youth Mental Health First Aid program to drive a generational culture change.
- Governor Hochul’s support for youth mental health has resulted in major investments into youth services and supports and nation-leading legislation to address online safety. Her $1 billion mental health initiative and subsequent budgets have significantly expanded access to mental health care and is providing resources for young people and their families.
- Governor Hochul secured $13.5 million in funding to be made available for schools that need assistance in purchasing storage solutions to help them go distraction-free.
- In the FY 2026 State Budget, Governor Hochul secured funding to establish new Youth Safe Spaces, which provide a place for young people to receive support in a comfortable setting, access emotional health and wellness resources, and foster positive relationships with their peers. She also secured funding to expand Teen Mental Health First Aid for High School Students, which will train both teens, and adults who work with teens, to identify, understand, and respond to signs of mental health and substance use challenges, including the impacts of bullying and school violence.
- Through significant investment from Governor Hochul, nearly 1,200 School-Based Mental Health Clinics are now operational, covering roughly 25 percent of all NYS public schools and 4 percent of private/parochial schools..
- Governor Hochul has also expanded access to home-based crisis intervention services to support up to 2,300 families during a behavioral health crisis to avoid unnecessary trips to the emergency room.
- Governor Hochul’s “Get Offline, Get Outside” campaign encourages New York’s kids and families to put down their phones and computers, take a break from social media, enjoy recreation and outdoor social gatherings, and put their mental and physical health first.
- This campaign builds on the governor’s efforts to promote healthy living among young people and families, including signing first-in-the-nation legislation to protect kids from addictive social media feeds and shield their personal data from online platforms.
- Governor Hochul this year also established first-in-the-nation safeguards for AI companion operators, requiring them to implement safety protocols.
Today, the Governor also met with grade-school kids and teen counselors of the Primetime585 Literacy and Movement Summer camp, who had the opportunity to attend Buffalo Bills training camp practice and discuss the importance of putting down their screens and getting on the field. PrimeTime585 Is one of the many programs that receive funding from the larger investment of $15 million in the FY26 budget to further support youth development and sports programming. PrimeTime585 works with kids and young adults to unite their community in the fight against racism and poverty.
